Introduction to the Dosimetry Law
The Dosimetry Law, officially known as Federal Law 15,402/2026, plays a crucial role in reshaping the legal landscape in Brazil, particularly concerning the calculation of penalties. This law was enacted to adjust how sentences are determined for individuals involved in significant political unrest, specifically for those convicted in the January 8, 2023 attacks on government buildings in Brasília.
Key Changes Introduced by the Law
This legislation introduces several significant modifications to the sentencing process. Firstly, it ends the practice of cumulative sentencing for crimes classified as “coup d’état” and “abolition of the democratic state of law” committed in the same incident. Consequently, defendants will serve only the more severe penalty instead of having their sentences added together.
Another important aspect is the accelerated progression in serving sentences. Under the new law, inmates can move to a less restrictive regime after completing just 1/6 (approximately 16%) of their sentence, regardless of any violent nature of the crime committed.
Impacts on Crowd Participants
A noteworthy provision of the Dosimetry Law includes the possibility of sentence reductions for individuals who participated in the demonstrations as part of a crowd. Individuals who were not leaders or financiers of these actions may receive a reduction of 1/3 to 2/3 of their sentences. This approach aims to distinguish between active leaders and those who participated in mass demonstrations.
The enactment of the Dosimetry Law represents a significant shift in Brazil’s approach to criminal justice, potentially altering how political protests are viewed and prosecuted in the future.
